“The individual in question is a regular rider of the TOR system and is well known to the driver. The driver indicated that the individual does not generally pose a threat to himself or others while onboard and has not previously created any disruptions. As a public transportation service, TOR drivers cannot deny entry unless they believe there is a threat. The driver stated that the individual did not pose a threat when he boarded and took a seat. At some point during the ride, the individual fell asleep or passed out and moved to the floor.
The driver knows that this individual normally gets off in Spring Valley. Upon arrival, the driver woke the individual, who was able to exit the bus on his own.
That said, the driver should have contacted dispatch to request police and/or medical assistance immediately, and their actions are now being addressed by Transdev through their established disciplinary process in coordination with the labor union.”
